Liability Waiver

Please read this Liability Waiver ("Waiver") carefully before participating in the nutrition and fitness programs ("Program") offered by Human Optimization Company, Inc. By participating in the Program, you acknowledge and agree to the terms and conditions outlined in this Waiver.

1. Assumption of Risk:

By signing up for or using our website and program you understand and acknowledge that:

• Participation involves physical activity, including but not limited to exercise, stretching, and dietary modifications.

• Such activities may carry certain risks, including, but not limited to, muscle strains, sprains, fractures, cardiovascular events, allergic reactions, and other physical or emotional injuries.

• You voluntarily assume all such risks and accept full responsibility for any injury or damage that may result from your participation in the Program.

2. Health and Medical Conditions:

By signing up for or using our website and program you understand, acknowledge and warrant that:

• You are in good health and physical condition to participate in the Program.

• You further confirm that you have consulted with a licensed healthcare professional regarding any pre-existing medical conditions, injuries, or illnesses that may affect your ability to engage in the physical activities involved in the Program.

• You agree to inform Human Optimization Company, Inc. of any changes to your health status or medical conditions that may arise during your participation in the Program.

3. Release and Waiver:

In consideration of being allowed to participate in the Program and by signing up for or using our website and program you understand, acknowledge that:

You, on behalf of yourself, your heirs, executors, administrators, and assigns, hereby release, discharge, and waive any and all claims, liabilities, damages, costs, or expenses, whether known or unknown, arising out of or in connection with your participation in the Program, including but not limited to those resulting from the negligence or misconduct of Human Optimization Company, Inc., its employees, agents, contractors, or representatives.

By signing up for or using our website and program you understand and agree to indemnify, defend, and hold harmless Human Optimization Company, Inc., its officers, directors, employees, agents, contractors, and representatives from any and all claims, liabilities, damages, costs, or expenses, including reasonable attorney fees, arising out of or in connection with your participation in the Program.

5. Personal Property:

By signing up for or using our website and program you understand and acknowledge that you are solely responsible for any personal property you bring to any of the Program premises or use from home. You release Human Optimization Company, Inc. from any liability for loss, theft, damage, or destruction of your personal property that may occur during your participation in the Program.

By signing up for or using our website and program you understand and acknowledge that your personal information will be handled in accordance with applicable privacy laws and Human Optimization Company, Inc.'s privacy policy.

7. Governing Law and Jurisdiction:

This Waiver shall be governed by and construed in accordance with the laws of Ontario, Canada. Any dispute arising out of or in connection with this Waiver shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.By signing up for or using our website and program you voluntarily agree to the terms of this liability waiver.
